Terms of Use

By creating an account or otherwise using WhereSit, you confirm that you are at least 13 years old (or the minimum age required in your jurisdiction) and that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

WhereSit is a voice-powered notes and reminders app. It transcribes your voice input, uses AI to automatically categorize and organize your notes, reminders, and to-dos, syncs your content across your devices, and lets you collaborate with others through shared groups. We may add, change, or remove features at any time to improve the Service.

You are responsible for the information you provide and for keeping your login credentials secure. You agree to provide accurate, current information and to keep it up to date. You are responsible for all activity that occurs under your account. Notify us promptly at WhereSit.app@gmail.com if you suspect any unauthorized use of your account.

You retain ownership of the voice recordings, notes, reminders, and other content you create in WhereSit (“Your Content”). You grant us a limited license to host, store, process, transcribe, organize, and display Your Content solely to operate and improve the Service and to provide its features to you and the people you share with. You are solely responsible for Your Content and for ensuring you have the right to share it.

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Upload or share content that is illegal, infringing, abusive, harassing, or that violates the rights of others.
• Attempt to access, tamper with, or disrupt the Service, its servers, or other users’ accounts or data.
• Reverse engineer, decompile, or attempt to extract the source code of the app, except where permitted by law.
• Use automated means to access the Service in a way that places an unreasonable load on our systems, or resell or commercially exploit the Service without our consent.

When you create or join a group, content you share becomes visible to other members according to the permissions set for that group. You are responsible for what you choose to share and with whom. We are not responsible for how other members use content you make available to them. Treat shared content as visible to everyone in the group.

WhereSit offers a free tier as well as optional premium plans that unlock additional features. Paid subscriptions are billed through the applicable app store (Google Play or the Apple App Store) and are subject to that store’s payment, renewal, and refund policies. Subscriptions renew automatically unless cancelled before the renewal date, and you can manage or cancel them in your app-store account settings.

The WhereSit app, including its name, logo, design, software, and underlying technology, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission. All rights not expressly granted to you are reserved.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not guarantee that voice transcription, AI categorization, reminders, or sync will always be accurate, timely, uninterrupted, or error-free. You are responsible for verifying important reminders and information, and you should not rely on the Service as the sole record of time-critical matters.

To the maximum extent permitted by law, WhereSit and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service, including any missed reminder or notification. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

You may stop using WhereSit and delete your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or where required by law. Upon termination, your right to use the Service ends; provisions that by their nature should survive (such as ownership, disclaimers, and limitations of liability) will continue to apply.

We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date above and, where appropriate, notify you within the app. Your continued use of WhereSit after the changes take effect constitutes acceptance of the revised Terms.
